Disclaimer / Exclusion of Liability

  1. Whilst ICMS Travel will take all responsible steps to provide an enjoyable tour, activity, entertainment package or golf day/event, it accepts no liability for any loss of enjoyment experienced by participants due to circumstances beyond its control. ICMS Travel further accepts no liability for any loss beyond its reasonable control and provides no warranties in addition to those set out in the Trade Practices Act 1974, and nothing herein restricts the passenger from excising their rights and remedies pursuant to law.
  2. There is no liability by ICMS Travel until ICMS Travel notifies the participant (by way of a booking confirmation and/or confirmation of payment advice) that moneys have been received by ICMS Travel.
  3. ICMS Travel, in some instances, will only act as agent for the operator/s of an element/s of the tour/activity/entertainment or golf package. Whilst ICMS Travel takes all reasonable care in selecting these operators it cannot accept responsibility for these operators conduct or the conduct of their representative/s, employees, and agents, or any ramifications of that conduct.
  4. Where golf is part of the prepaid arrangement/s the participant/client is bound by the rules of the clubs involved.
  5. The golf clubs, and other operators involved in the tours, maintain their own Responsibility and Liability conditions and a copy of same will be available to participants on request and before undertaking the tour or commencing of a golf program.
  6. ICMS Travel alone and/or the operator reserves the right to exclude a person from participating on a tour/activity/entertainment package or golf program, either before commencement or during the tour/activity/entertainment or golf game/event, if a person has a mental or physical condition which is, in the opinion of any representative of ICMS Travel or operator, such as to render them incapable of caring for themselves, or whereby they become objectionable to other participants, or they become a hazard to themselves or other participants.
  7. ICMS Travel and/or tour operator/golf club will not be responsible for expenses resulting in such persons being precluded from participating in, or completing the tour/activity/entertainment package or golf day/event.
  8. Whilst it is unlikely the content of tour itineraries and golf programs will change, ICMS Travel and/or the operator/s reserve the right to make alterations without notice. This alteration may be due to strikes, road or weather conditions, golf course closures, bushfires, local festivals, acts of nature, or other reasons.
  9. Neither ICMS Travel nor the tour operator are able to guarantee the exact arrival and departure times of any tour, activity or entertainment package and are not to be held liable for any missed connections nor any expense involved with delays.
